Terms and Conditions of Entry



1. Information on how to enter the Pinterest-y Christmas promotion (the Promotion) held by Lime Tree Kids Pty Ltd A.C.N.158 814 012 forms part of these terms and conditions of entry (Terms and Conditions).
2. Your participation in this Promotion is deemed to be your acceptance of these Terms and Conditions.  
3. The promoter of the Promotion is Lime Tree Kids Pty Ltd A.C.N.158 814 012 of Unit 2, 33 Olympic Circuit, Southport, Queensland 4215 (the Promoter). 
Definitions
4. In these Terms and Conditions and the Promotion:
a. AUD means Australian dollars;
b. Facebook page means the Lime Tree Kids Facebook page displayed at https://www.facebook.com/LimeTreeKids; 
c. Lime Tree Kids Blog means the blog displayed at https://www.limetreekids.com.au/blog.aspx; 
d. Major Prize means as specified in paragraph 12 of these Terms and Conditions.
e. Pinterest Page means Lime Tree Kids Facebook page displayed at http://www.pinterest.com/limetreekids/;
f. Pinterest Member means a person who has registered, been accepted as and continues to be a member of Pinterest (www.pinterest.com) and has agreed to all relevant and current terms and conditions of that membership; 
g. Prize means either a Weekly Prize or the Major Prize;
h. Weekly Prize means a prize as specified in paragraph 11 of these Terms and Conditions; and
i. Wishlist means a wish list generated and selected by you from the ten (10) items that you have nominated from the Lime Tree Kids catalogue.
Dates
5. The Promotion commences at 10.00am (AEST) on 8 November 2013 and closes at 9.00am (AEST) on 19 December 2013 (the Promotion Period).
Entries
6. Participation in this Promotion is only open to those persons who:
a. are residents of Australia;
b. are aged 15 years or older;
c. are a Pinterest Member; and
d. otherwise fulfil the requirements set out in these Terms and Conditions.
7. An entrant may only submit one (1) entry during the Promotional Period.
Game of chance
8. This Promotion is a game of chance with eligible applicants, during the Promotion Period, being required to:
a. Follow Lime Tree Kids on Pinterest (http://www.pinterest.com/limetreekids/);   
b. Create a Pinterest Board with the title "Lime Tree Kids Christmas Gift Picks";
c. Re-pin this pin to your new Pinterest Board;
d. Download the Lime Tree Kids catalogue (https://www.limetreekids.com.au/catalogue.aspx) and re-pin ten (10) items from the catalogue to your Pinterest Board;
e. Use the #limetreekids hash tag in each of your descriptions;
f. Copy and paste the link to YOUR Pinterest Board in the Comments section below so that we know that you have entered; and
g. Read and agree to these Terms and Conditions, including the Promoter’s Privacy Policy.
Prizes
9. The Weekly Prizes will be allocated as follows:
a. Week 1 – 4 winners of 1 x Tiger Pack each (Valued at up to $114.55 each);
b. Week 2 - 1 x Janod Chic Maxi Kitchen BROWN (Valued at $170);
c. Week 3 - 1 x Hollie and Harrie Beach Sombrilla (Valued at $180);
d. Week 4 - 1 x IVI 3D Large Playing Family Rug (Valued at $229.95);
e. Week 5 – 4 winners of 1 x Just For Mum Pack (Valued at $186.95 each); and
f. Week 6 – 2 winners of 1 x Ultimate Christmas Wishlist (valued at up to $250 each).
10. The Major Prize will be 2 x Ultimate Christmas Wishlist (valued at up to $250).
11. The total value of the prize pool for this Promotion is up to $2,038.15 AUD.
12. All prizes are subject to availability. In the event that an element of the Prize is cancelled or unavailable for any reason, then the winner of a Prize forfeits the specific element and no cash or alternative offer will be granted in lieu of that part of a Prize.
13. A Prize, or any part of it, is not exchangeable, transferable or redeemable for cash.
14. An entrant may only win one (1) Weekly Prize throughout the duration of the Promotion but may win a Weekly Prize and the Major Prize.
Drawing of Prizes
15. The winner of a Prize will receive one Prize only. 
16. A total of 14 winners will be drawn throughout the duration of the Promotion.
17. The closing date for entries each week is at 8.00am (AEST) on the following dates:
a. Week 1 – 14 November 2013
b. Week 2 – 21 November 2013
c. Week 3 – 28 September 2013
d. Week 4 – 5 December 2013
e. Week 5 – 12 December 2013

18. The winners of a Weekly Prize will be drawn at 9.00am (AEST) on the following dates:
a. Week 1 – 14 November 2013
b. Week 2 – 21 November 2013
c. Week 3 – 28 November 2013
d. Week 4 – 5 December 2013
e. Week 5 – 12 December 2013
f. Week 6 – 19 December 2013
19. Details of all winners of a Weekly Prize will be included in the Lime Tree Kids Friday Newsletter on the following dates:
a. Week 1 – 15 November 2013
b. Week 2 – 22 November 2013
c. Week 3 – 29 November 2013
d. Week 4 – 6 December 2013
e. Week 5 – 13 December 2013
f. Week 6 – 20 December 2013
20. The winner of the Major Prize will be drawn on 20 December 2013 at 9.00am (AEST).
21. Details of the winner of the Major Prize will be included in the Lime Tree Kids Friday Newsletter on 20 December 2013.
22. All winners of a Prize will be notified by email and via the Facebook Page immediately after being drawn as a winner.
23. All winners of a Prize must claim their Prize by no later than seven (7) days of being notified.
24. If a winner of a Weekly Prize does not claim their Prize within seven (7) days of being notified, then that person will forfeit the Prize and that Prize will be redrawn, with the process outlined above taking place once again, until such time that all winners have claimed all Prizes.
25. In order to claim any prize, a person who wins a prize must be able to prove they were eligible to enter the Promotion at the time of submitting an entry. Failure to do so will result in their prize being forfeited.
General Conditions
26. The following general conditions apply to the entire Promotion. 
Entrants aged under 18 years
27. All entrants aged under 18 years must confirm that he or she has obtained consent from a parent and/or guardian to participate in the Promotion.
Copyright
28. All submissions must be the work of the individual submitting them and must not have been published elsewhere or have won a prize in any other competition or promotion. It is the responsibility of each entrant to ensure that any images they submit have been taken with the permission of the subject and do not infringe the copyright of any third party or any laws. Entrants must warrant that the entry or entries they are submitting comprises their own work and that they own the associated copyright.
Pinterest and Facebook acknowledgements 
29. Participation in this Promotion is considered acceptance of the following:
a. a complete release of Pinterest and Facebook by any entrant;
b. an acknowledgement that this Promotion is in no way sponsored, endorsed or administered by, or associated with Pinterest or Facebook; and
c. that the information provided by each entrant is provided to the Promoter and not to Pinterest or Facebook.
30. Participation and entry in this Promotion is conditional upon the entrant complying with all rules, regulations and guidelines set down by Pinterest.
Entries
31. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to participate in or enter the Promotion. 
32. The Promoter reserves the right, at any time, to verify the validity of all entries and the eligibility of all entrants, including their identity, age and place of residence, and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.
33. The use of any automated entry software or any other mechanical or electronic means by an entrant to automatically enter the Promotion is prohibited and will render all entries for that entrant invalid.
34. Any costs associated with becoming eligible to apply, applying or participating in this Promotion, such as access to the Internet and download costs, will be at the cost of the entrant.
Prizes
35. Prizes (and parts thereof) are not transferable or exchangeable and cannot be taken as cash.  
36. The Promoter will not be responsible (and an entrant will not be entitled to make any claim for compensation) for any variation of a Prize, or the value of it, during the Promotion Period or thereafter.
37. If any Prize (or part thereof) is unavailable, the Promoter, in their discretion, reserve the right to substitute all or any part thereof with a product or prize to the equal value and/or specification.
38. Should an entrant’s contact details change during the relevant Promotion Period, it is the entrant's responsibility to notify the Promoter. 
39. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality/suitability of a Prize.
40. As a condition of accepting a Prize, the winner or recipient of a Prize may be requested to sign a legal release and indemnity form.
41. All values and amounts that appear in these Terms and Conditions are inclusive of GST unless expressly stated otherwise.
Variations to the Promotion
42. The Promoter may, in its absolute discretion, but subject to any relevant law, modify, suspend, cancel or recommence this Promotion, as appropriate, if:
a. for any reason, this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical or software failures or any other causes beyond the control of the Promoter, which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion; or
b. the entry process, the determination of the Prize winner and/or the delivery of a Prize is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.
43. Where the Promoter does modify, suspend, cancel or in any way amend the Promotion, the Promoter will provide notice via the Facebook page and the Lime Tree Kids Blog.
44. Any cost associated with accessing any website associated with the Promotion is the responsibility of an entrant and is dependent on the Internet service provider used. 
Limitation of Liability
45. Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Promotion, including, but not limited to, where arising out of the following: 
a. any technical difficulties or equipment malfunction (whether or not under the control of the Promoter); 
b. any variation in value of a Prize to that stated in these Terms and Conditions;
c. any tax liability incurred by a winner or entrant; or
d. participation in the Promotion.
This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
Use of personal information
46. An entrants and/or a winner of a Prize consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media, including both online and offline media, for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products or serviced manufactured, distributed and/or supplied by the Promoter. 
47. The Promoter collects personal information in order to conduct this Promotion and may, for this purpose, disclose such information to third parties, including but not limited to the Promoter, agents, contractors, service providers and suppliers of prizes. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending commercial electronic messages or telephoning the entrant. An entrant should direct any request to access, update or correct information to customerservice@limetreekids.com.au. 
Ownership of Submissions
48. All entrants will retain ownership of copyright in any entry submitted in the Promotion. However, in making a submission and entering the Promotion, an entrant provides the Promoter with a world-wide, royalty free and irrevocable licence to use the content of any submission made to enter the Promotion.
49. The Promoter’s Privacy Policy may be accessed here
General
50. If any term or condition contained herein shall be or become illegal, invalid or unenforceable, the same shall be read down, if such reading down is possible, and if found to be impossible, shall be severed and the remaining terms and conditions shall not be affected.
51. This Agreement is to be interpreted in accordance with the laws of Queensland, Australia and all parties submit to the non-exclusive jurisdiction of those Courts.
